Terms & Conditions

Circle Luxury Stays

These terms and conditions provide you with the basis upon which Circle Luxury Stays accepts your booking and charges for its services. By confirming the booking you are accepting these terms and conditions as provided on the Circle Luxury Stays website. Bookings made through your online booking system are provisional until confirmation is sent to you.

This agreement is made on the basis that (“the Property”) is to be occupied by you for a holiday as mentioned in the Housing Act 1988 Schedule 1 Paragraph 9. You acknowledge that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise on the determination of the Term. 

 

Damages Deposit / Additional Charges

 

 

PAYMENT

 

You must pay the deposit of £1,500 for the Water Tower in Devon and £100 for all apartments in Bath. The balance of the payment is due 6 weeks prior to your stay.

 

It is your responsibility to keep the interior and contents of the property in the same state of repair and cleanliness as at the beginning of the letting, allowing for reasonable wear and tear. In the event of any breakages, damage or extra cleaning required after you have vacated, Circle Luxury Stays will notify you within three weeks of vacating the premises advising the damages caused and any costs incurred. Circle Luxury Stays reserves the right to add a reasonable administration fee to cover the time incurred dealing with the damages.

 

REPAYMENT

 

Circle Luxury Stays shall return to you within seven days from the final day of the letting, the deposit, less any costs reserved for damage, provided:

 

  • no damage is done to property or its contents, beyond normal wear and tear;
  • no charges are incurred due to illegal activity, pets or collection of rents or services rendered during the stay;
  • all rubbish and debris are placed in rubbish bin, and soiled dishes are placed in the dishwasher and cleaned;
  • the properties (Water Tower, Rousdon, Devon, DT7 3XR) are locked and the pool room key is left on the console table in the hallway;
  • all charges accrued during the stay are paid prior to departure;
  • no fixtures, fittings or contents (including linens) are lost or damaged;
  • the guest is not evicted by the owner (or representative of the owner) or the local law enforcement.

 

Any evidence of dogs or other animals in the house or garden will result in a total forfeit of the deposit.

 

 

 

Holiday Letting Payment

PAYMENT & CANCELLATION

Once the deposit has been made, we will confirm your booking. Full payment will be required 8 weeks prior to checking in. Payment methods are bank transfer or cash.

CANCELLATION BY THE GUEST LESS THAN 12 WEEKS PRIOR TO THE BOOKING START DATE

All cancellations must be made in writing. Should you need to cancel the booking all monies paid by you to Circle Luxury Stays shall be refunded in full less an administration fee of £150, provided that such cancellation is made twelve weeks prior to the first day of the letting. You should arrange your own cancellation insurance.

Should you need to cancel the booking less than twelve weeks prior to the first day of the letting you will remain liable for all costs due under the booking for the whole period or for such part of the booking which is less than twelve weeks from the cancellation date. Circle Luxury Stays recommend that you take out holiday cancellation insurance at the time of booking.

CANCELLATION BY CIRCLE LUXURY STAYS

Should Circle Luxury Stays need to cancel the booking all monies paid by you to Bath Circle shall be re-funded in full. We reserve the right to cancel any letting should you or any member of your party misuse or cause damage to the property, its furniture or contents, or should you create a serious disturbance to any adjoining neighbours.

 

Arrival

ENTRY CODE

Access to the Circle Luxury Stays house and apartments is via an electronic key pad which requires a code. Guest entry codes will be provided with booking confirmation or send on the day of arrival.

 

Condition of the Property

CIRCLE LUXURY STAYS’ OBLIGATIONS

Circle Luxury Stays shall ensure that the Property is let in a clean and tidy condition.

ALTERATIONS

You must not damage or injure the Property, make any addition to the Property, unite the Property with any adjoining premises, or make any alteration to the Property or to the services or service media in the Property.

CONTENTS

You must maintain the contents and the Property in the same state and condition as at first day of the letting. You should report any damage and pay to Circle Luxury Stays the value of any part of the Property or its contents damaged or destroyed which are incapable of being restored to their former condition.

REPAIR

Under no circumstances should you attempt repairs to the Property or its contents. You must report any damage or faults in the Property or its contents to Circle Luxury Stays immediately.

 

Rights of Entry

You must allow Circle Luxury Stays, with any necessary contractors and workmen, to enter the Property at reasonable times upon prior notice or in the event of emergency at any time without notice, to view the state and condition of the Property and the contents should Circle Luxury Stays have any concerns; and to carry out any repairs that are necessary to the Property or to any adjoining property that can only be carried out by having access to the Property.

 

Dealings

This agreement is personal to the Lead Guest. You must not transfer, sublet or part with or share possession of the Property or any part of it.

 

Use & Nuisance

RESIDENTIAL HOLIDAY USE

You must use the Property for the purpose of a private holiday residence for a maximum of listed occupancy persons only and not for any other purpose.

NUISANCE

You must not do anything on the Property that may reasonably be considered to be a nuisance or annoyance to Circle Luxury Stays or the occupiers of adjacent or neighbouring properties.

SMOKING

Smoking is not permitted. You must not spoke inside or on the ground of the Property.

PARTIES

No Hen and stag parties are allowed.

PETS

You must not keep or allow any animal, bird or reptile at the Property.

NOISE

You must not play any musical instrument or device and must not allow noise from any machine or equipment to be heard outside the Property in such manner that may cause a disturbance after 2300 hours or before 0800 hours on any day.

GUEST NUMBERS

Only the guests whose details have been provided at the time of booking will be permitted to stay at the Property unless Circle Luxury Stays provide consent in writing.

The owners reserve the right to refuse access to the property without compensation where no agreement has been given in advance. The guests’ right to occupy the property may be forfeited without compensation, or an additional charged levied, if: (a) more people or guests than specified on the booking and/or the number the property holds, attempt to take up occupation; (b) overnight guests are entertained without the owners’ express permission; (c) any activity is undertaken which may cause unreasonable damage, noise or disturbance.

Unless expressly agreed in advance by the owners, no group bookings are accepted where all members are of the same sex, unless the group consists of members of the same family across a number of generations.
